Terms of Service

1. Acceptance
By accessing or using VoiceOps (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service. These Terms form a binding agreement between you (“Subscriber” or “you”) and [Company Name] (“VoiceOps”, “we”, “us”, “our”).
This is a DRAFT document. It has not yet been reviewed by legal counsel and should not be relied upon as a final statement of our terms. These Terms will be updated before the Service launches publicly.
We may update these Terms from time to time. Material changes will be communicated in accordance with Section 8 (Changes to These Terms).
2. Description of Service
VoiceOps provides autonomous AI-powered telephone call handling. The Service offers two primary capabilities:
- Inbound call answering: VoiceOps provisions a phone number for your business. When a caller dials that number, a VoiceOps AI voice agent answers the call, conducts a structured conversation with the caller, handles appointment bookings or general enquiries, and sends you a summary and transcript via Telegram.
- Outbound calling: Consumer users can instruct VoiceOps to place a call on their behalf to complete a specified task (such as booking an appointment at a business). The agent places the call, carries out the task, and reports the outcome and a transcript back to you.
The Service is delivered through Telnyx’s telephony infrastructure, Anthropic’s AI models, and supporting services described in the Privacy Policy. The availability and feature set of the Service may change over time; we will communicate material changes with reasonable notice.
3. Subscription and Billing
3.1 Plans and pricing
VoiceOps is available on a monthly subscription basis. Current plans are:
- Basic — $399 per month: Autonomous inbound call handling for your business, including a dedicated VoiceOps phone number, unlimited call answering, Google Calendar sync, and Telegram notifications.
- Extended Support — $699 per month: Everything in Basic, plus priority onboarding, faster support response SLAs, and custom agent configuration assistance.
All prices are quoted in US dollars and are exclusive of applicable taxes. You are responsible for any sales, value-added, or similar taxes applicable in your jurisdiction. We reserve the right to change pricing with at least 30 days’ written notice to your account email address.
Subscriptions are billed monthly in advance. Payment is processed by Stripe. By subscribing, you authorise VoiceOps to charge your nominated payment method on a recurring monthly basis until you cancel.
3.2 Cancellation
You may cancel your subscription at any time through the billing management portal within your VoiceOps account. Cancellation takes effect at the end of the current monthly billing period — call handling and all Service features will remain active until that date.
No refunds are issued for unused portions of a billing period, including where you cancel mid-month or where the Service is not used. Following cancellation, your account will transition to inactive status at the end of the billing period; your VoiceOps phone number will be released and call handling will cease.
If your payment fails and is not resolved within [X days — to be specified], we reserve the right to suspend or terminate your account.
4. Call Recording and Compliance
The VoiceOps voice agent records all calls it handles and generates a text transcript of each conversation. At the start of every call — both inbound and outbound — the agent discloses that it is an AI assistant and that the call is being recorded. This disclosure occurs before the agent requests or receives any substantive information from the other party.
Many jurisdictions impose legal obligations regarding consent to call recording. These rules vary significantly by location and are commonly referred to as “two-party consent” or “all-party consent” laws. In the United States alone, multiple states (including California, Florida, Illinois, and others) require that all parties to a call consent before recording begins. Similar rules apply in Canada, Australia, the United Kingdom, and the European Union.
As a Subscriber, you are solely responsible for ensuring that your use of VoiceOps complies with all applicable laws and regulations in the jurisdictions in which calls are made or received, including all requirements relating to call recording consent and disclosure. VoiceOps’s built-in AI identity disclosure and recording notice is intended to facilitate compliance but does not constitute legal advice and cannot be guaranteed to satisfy the requirements of every jurisdiction or use case. You should obtain independent legal advice if you are uncertain about your obligations.
You agree not to use VoiceOps to:
- Record calls in any jurisdiction where doing so is prohibited or requires consent that has not been obtained.
- Use call recordings or transcripts for any purpose that is unlawful or that violates any third party’s rights.
- Impersonate a human caller in circumstances where the applicable law prohibits the use of AI or automated systems for the purpose in question.
5. Acceptable Use
You may use VoiceOps only for lawful purposes and in strict compliance with these Terms. Without limiting the foregoing, you agree not to:
- Use the Service to conduct fraudulent, deceptive, harassing, threatening, or abusive calls.
- Use the Service to violate any applicable telephone consumer protection, privacy, anti-spam, or telemarketing laws (including the US Telephone Consumer Protection Act (TCPA), the UK Privacy and Electronic Communications Regulations, and similar legislation).
- Use the Service in connection with any illegal scheme, pyramid scheme, phishing, or other fraud.
- Attempt to reverse-engineer, decompile, disassemble, or otherwise misappropriate any part of the VoiceOps platform, its AI models, or its underlying telephony infrastructure.
- Resell or sub-license access to the Service without our prior written consent.
- Use the Service in a manner that places excessive or unreasonable load on our systems or infrastructure.
You are responsible for all calls placed or received using your VoiceOps account, and for all use of the Service under your credentials. If you become aware of unauthorised use of your account, you must notify us immediately at contact@voiceops.ai.
We reserve the right to suspend or terminate your account without notice if we reasonably believe you are in breach of these acceptable-use provisions.
6. Data and Privacy
Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read the Privacy Policy and consent to the collection, processing, and storage of call recordings and transcripts as described therein.
Where VoiceOps processes personal data relating to your end-customers (callers) on your behalf — for example, by recording and transcribing conversations with people who call your VoiceOps number — you act as the data controller and VoiceOps acts as a data processor. In this capacity, VoiceOps will process such data only on your documented instructions and in accordance with applicable data protection law. A separate Data Processing Agreement is available upon request for subscribers who require one for regulatory compliance.
7. Limitation of Liability
To the maximum extent permitted by applicable law, VoiceOps and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, or the cost of substitute services, arising out of or in connection with your use of — or inability to use — the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any and all claims arising under or in connection with these Terms or the Service shall not exceed the total subscription fees you paid to VoiceOps in the three (3) calendar months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by our negligence; or (c) any other liability that cannot lawfully be excluded or limited under applicable law.
VoiceOps is not responsible for any failure or degradation of the Service caused by third-party providers (including Telnyx, Anthropic, Deepgram, or ElevenLabs), telecommunications infrastructure failures, or circumstances beyond our reasonable control.
8. Changes to These Terms
We may update these Terms from time to time to reflect changes in the law, our business practices, or the Service. Where changes are material, we will notify you by email to your registered address and/or by a prominent notice within the Service at least 30 days before the updated Terms take effect.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must cancel your subscription before the effective date. Non-material changes (such as corrections to typographical errors or clarifications that do not affect your rights) may take effect immediately.
